A recent (April 8 2016) judicial decision in the federal lawsuit involving children, James Hansen, and others as plantiffs, and Obama and the fossil fuels industry as defendants permits the case to go forward in the Federal District Court in Eugene, Oregon. A motion to dismiss by the defendants was rejected by the Judge with numerous clearly stated reasons, among these being the application of the Public Trust Doctrine by which the government has the obligation and responsibility to protect its citizens from harmful aspects of our atmosphere, namely climate change. So if the court decides the US government has a postive obligation to prevent increased CO2 releases to the atmosphere, there would be a constitutional bligation ot stop countries like China by force if they did nto willingly cease their emmissions. YeE hAw

Should there not also be a class action lawsuit against all emitters of carbon dioxide?

There are major costs to civilization & the environment of fossil emissions, including CO2, methane, NOx, SOx, Benzene and a long list of others. Fossil producers get a free ride on those costs which amounts to a major subsidy for fossil. Also a subsidy to Wind & Solar since they cannot function without fossil fuels. What is rational would be a Carbon Fee and Dividend to add those costs to fossil producers and eliminate that massive subsidy to Fossil.
