The above link is to a piece on Salon a few days back reporting the indefinite detention of citizen journalist Roger Shuler of Shelby county, Alabama. Shuler is being held in the Shelby county jail indefinitely for charges related to terrorism. Shuler These charges stem from various posts Shuler placed on his blog exposing corruptions involving high level republicans in Alabama -some of which were apparantly not entirely factual. I haven't had the time to delve deeply into the story but, of the research I have done, it is becoming more clear the real reason for Shuler's run-in with the law is he was exposing connections former governor Bob Riley's (R) -AL) son has and that the Riley's and the AL republican party are trying to keep quiet.

The content of the stories Shuler published is not what I am at odds with. It doesn't really matter YET what Shuler wrote, but that he has the right to say & write what he wants -whether as a journalist or just opinion. The judge in this case -whose name escapes me- ordered "prior restraint" to Shuler for any future stories he may learn of Riley -whether they happened prior to the hearing or incident or after.

This man is being held without bond or being charged with a crime because he exercised his constitutional right to free speech -specifically, he was reporting the activities of individuals who have very much power & influence over what our tax dollars are spent on here in Alabama.

I hope this story finds its way to air, Thom. It's not been mentioned on the corporates and I've sent it to every alternative site I know to no avail yet.

Roger Shuler, trendsetter. Journalist jailed but not for journalism.

This is a good example of what well-meaning folks can do when they catch something in the middle (but they think it was the beginning).

Subject Shuler was not out to make any friends with his blog.

The First Amendment gives us the right to Free Speech (not immunity from prosecution if we use that speech to dishonestly slander, defame, incite, etc.) but the distinction is not well-schooled to the general population.

Having been called to prove or remove certain assertions he had posted on his blog - he ignored the court order and was then cited for contempt of court by Judge Claud Neilson.

But the Judge went too far and also issued an order for him to not post anything further about the Governor's Son on his blog. The pre-emptory nature is what makes it improper. Even if the next post was going to be totally defamatory - one has the right to do so - have there day in court - and then pay the piper if the piper is to be paid.

Anyway, violating the first order (to remove the unproven slanderous stuff from his blog) led to his arrest on October 23, 2013.

A couple months after this topic was posted and he had the material removed from his blog, on March 26, 2014 he was released on probation and told that the injunction on certain writing was permanent.

He appears to be having difficulty distinguishing between being right on one thing and being right on everything.

Then in June 2014 a new arrest warrant was issued to revoke his parole because he had not paid court order fees and fines and did not appear when ordered.

But wait...there's more ! It's ALABAMA !! (can you say "free-Don" ?)

While Shuler was incarcerated for Contempt of Court for not removing the offensive matter from his Blog quickly enough - the Shelby County District Attorney's Office prosecuted him for having resisted arrest back on October 23, 2013 and were able to add "misdemeanor resisting arrest" to the blogger's rap sheet with a January 14, 2014 conviction (while he was in jail on the contempt charge).

He received a 90-day sentence, with a two-year suspension from Judge Ronald E. Jackson. It was this same judge that later, in response to the motion filed by the D.A. office on May 29th, ordered he be arrested on the probation revocation complaint.

In the meantime, the Governor's Son, won a $24,425 judgment in the case.

Now, Spartan Value Investors LLC claims it purchased the Shuler home at a foreclosure auction on the Shelby County Courthouse steps on April 29, 2014 and on May 29th gave the Shulers 10-day notice to surrender the property.

Injustice meets irony in that he had originally started the Blog because of a property dispute with a neighbor.

And now, with all the cowardly piling on, it really does look like all of his legal troubles (leading to his financial ones) can be traced back to the enemies he made with his previous speaking-truth-to-power Journalism.

It appears that Alabama wants credit as being the first instance of:

antidissidentcomplimentarianism

which is the neoJournalism that excludes all nonoligarch points of view and greatly encourages reporters to be enthusiastic supporters of the owners' political poisitions.
