Thom needs to get a better argument from Thomas Jefferson about judicial review than the letter to Spencer Roane. I just can't believe that it took Jefferson 16 years to get around to writing anything about a Supreme Court case that concerned his own government. And sure, he uses Marbury v. Madison as an example of his opinion, but he does not say in the letter what judicial act his opinion concerns. We need Roane's prior letter to Jefferson to be sure.
