Before the 14th Amendment, U.S. citizenship derived from state citizenship, and the amendment put it the other way around.

While the topic is up, the way I'd rewrite the citizenship clause of Section 1 is: "All persons born to two citizens of the United States, or born in the United States to one citizen of the United States shall be natural-born citizens of the United States. All other persons shall not be citizens of the United States unless naturalized according to law. All citizens of the United States shall be citizens of the State wherein they reside."

If all countries adopted this, then only a strange case like Ted Cruz wouldn't get automatic citizenship from some country. And it's possible to take care of him (presuming his father was a legal resident of the U.S.) by adding in cases of legal residency, though the wording gets a bit cumbersome.

I wish I could fill in for Thom during this week and a half to do a specialized show about how the U.S. Constitution could be improved. It'd be a great way to teach people about civics, the principles of constitutional frameworks, and the pragmatic side of political mechanics.
