It's Article VI of the Constitution that says "no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States."

The Establishment Clause is the part of the 1st Amendment that says "Congress shall make no law respecting an establishment of religion".

I think Thom's analogy between prohibition and Bain Capital is backward. Bain is a problem because its activities were made legal, whereas moonshining arose because liquor was made illegal.
