Why should Vermont wait until the U.S. Supreme Court announces its decision on ObamaCare before putting their own health insurance system in place? If SCOTUS strikes ObamaCare down, it will be on the basis of what the federal government is allowed to do, but state governments supposedly have stronger rights to govern. The only things the states can't do are the things the U.S. Constitution says explicitly that they can't do, mostly making war and regulating trade.
I voted yes,but I am ever the optimist. It will take getting rid of the radicals in the House, which will be no easy task considering all the Super Pac money that will spread dis information, distortions and outright lies during the election year. It will take real grass roots action to get a majority back in the House and retain or increase the Democratic majority in the Senate.

The other day we had that Texan attorney here, who felt like it was dangerous to have the trained killers of our armed forces at home right now. What does this mean.... it means that YOU quoted the Constitution wrong/ incorrectly, or at best... only partially. You implied that the Constitutional Powers of the Supreme Court are ALL subjective to the Congress when indeed the sentence you use DOES state that (in part)... but, the sentence before it does NOT!

1. Constitution is the supreme law of the land. Constitution says this about itself - See Article VI Paragraph 2.
2. One responsibility of the courts is to ascertain what the law is and how it is to be applied..
3. No law passed by congress or by the states may supercede the supreme law of the land.
4, Therefore, the SCOTUS (and other courts) can determine that a law is contrary to the constitution and therefore be null and void.
I can understand your anger about the Citizens United case. It is constitutionally correct but, I agree, it is bad law. Would you like to see Roe v. Wade nullified via nullification of judicial review? Seems to me that having the court decide whether laws are constitional based on actual cases (not arbitrary review) is an appropriate function - otherwise the Legislatures (Federal and State) would be the absolute authorities. If this were the case, we would be exposed to mob rule which our founders wished to forstall.
The US is a representative democracy and a republic. It is not and should not be a mobocracy.
By the way, based on my understanding of the Constitution and some case law (I took university-level courses in Con Law), I think that this Healthcare law (PACA) is not constitutional. The other day we had that Texan attorney here, who felt like it was dangerous to have the trained killers of our armed forces at home right now. Shipping them to the kangaroos didn't make sense and this was the reason why I felt, lefties where trashing him to quick for that. Because now it does make sense, in case that attorney should be right.
How much does our President hate being dependent on corporate money? I don't know, but I heard even Newt Gingrich talking about he wouldn't like that as Congressman. Because it sucks, if all the time you have to be after the money and find people who finance your work. So why should our President like being dependent on corporate money?

I have plenty of hope, because the GOP is so extremely paranoid these days. They scare their voters away and this might get ourselves the most progressive Congress we've ever seen in our lifetime! This is a chance to really change the country gravely and bring it on a progressive path. A liberal/ progressive/ Keynesian dominated Congress would cut the president office's power radically down -- and really ought to. Even if Mitt Romney was the president, instead of Barack Obama, he wouldn't be able to attack Iran. No, as I feel, the first thing they would vote on would be, taking away his right to decide on war and peace. Only Congress is supposed to decide that!What else would Congress do? I tell you, Wall Street would be severely scared..... Congress can arrest anybody and I like that! They make the laws for what crime we go to prison and I like that! Right now it doesn't work, because of all those goofy Republicans and blug-dogs. That is our problem, not the president. Even Adolph Hitler couldn't rule against a 100% liberal United States Congress -- it wouldn't work. He would just bawl about the house, but it wouldn't help him.
What else would a progressive Congress do? Supreme Court would change -- I thought that over : why not let the American people vote judges in -- every other midterm election? Just add another column to the midterm ballot. That would mean, they stay in office for 8 years at the most.

I notice that you have the "T" at the beginning of your quote of Judicial Powers in brackets (at about 6:55 in the video)... that is because it is common courtesy when interupting a quote to indicate so by changing the case of the first letter (as though it started the sentence) when it does NOT start the sentence. What does this mean.... it means that YOU quoted the Constitution wrong/ incorrectly, or at best... only partially. You implied that the Constitutional Powers of the Supreme Court are ALL subjective to the Congress when indeed the sentence you use DOES state that (in part)... but, the sentence before it does NOT!
"In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction."
Now, that does NOT say subjective or regulated by Congress.... it says ORIGINAL JURISDICTION. (BTW I capitalize for emphasis not yelling....)
The full quote (that would NOT have backed your line of thinking, so hence was..... modified) should be.....
" In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make."
That means that the Supreme Court has TWO powers directly mentioned in the Constitution.... Appellate and Original Jurisdiction. The way to tell when which should apply is to determine what the case is about and who brings it. And since the case in debate involves States.... it would seem that the Original Power clause would be applied (that's the one you failed to mention).

I've been wanting to "rant" back at you ever since I heard your rant. You have either ignored or not read John Marhall's logic. JUst for the record, here is a condensation:
1. Constitution is the supreme law of the land. Constitution says this about itself - See Article VI Paragraph 2.
2. One responsibility of the courts is to ascertain what the law is and how it is to be applied..
3. No law passed by congress or by the states may supercede the supreme law of the land.
4, Therefore, the SCOTUS (and other courts) can determine that a law is contrary to the constitution and therefore be null and void.

I can understand your anger about the Citizens United case. It is constitutionally correct but, I agree, it is bad law. Would you like to see Roe v. Wade nullified via nullification of judicial review? Seems to me that having the court decide whether laws are constitional based on actual cases (not arbitrary review) is an appropriate function - otherwise the Legislatures (Federal and State) would be the absolute authorities. If this were the case, we would be exposed to mob rule which our founders wished to forstall.
The US is a representative democracy and a republic. It is not and should not be a mobocracy.
By the way, based on my understanding of the Constitution and some case law (I took university-level courses in Con Law), I think that this Healthcare law (PACA) is not constitutional.
