OK so if my American Mother gave birth to me outside the country while on vacation (lets just say for the sake of argument), does that actually mean I'm not an American Citizen, is the law really setup that way? I find that hard to believe.
@mstaggerlee, if a company is actually producing a patented item, I'm OK with them being allowed an extended period of ownership of the item, say up to 50 years; being that a life time expectancy of a human is somewhere around 70 years, and that an inventor would probably be about 20 years of age at least when filing a patent, just putting that as a basis for a reasonable lifetime expectancy for an individual to profit off of a patent. Not unlike the average working life of an individual. My 5 year cutoff was basically putting forth, that if a company/individual, can not show that it's trying to put the product into production (whether or not they are making a profit), then have it released into the public domain. Use it or loose it law.

Or perhaps the period should be different, depending upon whether the patent rights are held by the original inventor, or by someone who bought (or obtained in some other manner) them from him.
A garage-based entrepreneur who patents an original idea may need considerable time to obtain the resources required to go into any kind of significant production. However, when an oil company obtains a patent for a solar energy device, and keeps it under wraps in order to maintain the status quo that supports their business model, we MUST not allow such a practice to endure in perpetuity.
I beleive the same should apply to copyrights. 20 years is the longest one should be able to profit on a single idea. Make what you can on it in 20 years, and if that's enough to support you for the rest of your life, congratulations. If not, then go have another idea.
This is why I hope and pray that wherever the soul of Senator Sonny Bono (who gave us the Millenium copyright act) may now reside, he's spending all of eternity skiing into that blessed tree!
